HYDRATE_TERMS

TERMS FOR USING HYDRATE

Effective 5 November 2026 · Version 1.0

These terms govern your use of the Hydrate app for Android (“the app”), published by Glen Muthoka Mutinda (“the developer”, “we”, “us”). By installing or using the app you agree to these terms. If you do not agree, please do not use the app. Nothing in these terms limits any rights you have as a consumer under the mandatory law of the country in which you live.

1. The service

Hydrate helps you record your water intake, set a daily hydration goal, receive reminders, synchronise with Health Connect, Samsung Health and compatible smart bottles, and locate a paired bottle. The app is provided free of charge and does not require an account.

2. Not medical advice

Hydrate is a general wellness app. It is not a medical device and is not intended to diagnose, treat, cure, monitor or prevent any disease or medical condition. Recommended daily goals are general estimates based on published dietary reference values and the information you provide; your actual needs may differ.

Consult a qualified healthcare professional before changing your fluid intake if you are pregnant or breastfeeding, have a heart, kidney or liver condition, are subject to a fluid restriction, or take medication that affects fluid balance. Excessive water intake can be harmful. Do not disregard professional medical advice because of information shown in the app.

3. Licence

Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Android devices that you own or control, for your personal, non-commercial use. Where parts of the app are made available under an open-source licence, that licence governs those parts and prevails over this section to the extent of any conflict.

4. Acceptable use

You agree not to use the app in breach of any applicable law, not to interfere with or disrupt the app or the devices and services it connects to, and not to misrepresent the app or its origin.

5. Third-party services and devices

The app can work with services and products provided by third parties, including Health Connect, Samsung Health, Google Maps and smart water bottles. Your use of these is subject to their providers’ own terms and privacy policies. We are not responsible for the availability, accuracy or conduct of third-party services or devices.

Hydrate is an independent app and is not affiliated with, endorsed by or sponsored by the manufacturer of any supported bottle. All trademarks belong to their respective owners and are used only to identify compatible products. Pairing, calibration and registration features may reset settings stored on a bottle; please follow the on-screen instructions carefully.

6. Privacy

Our Privacy Policy explains how the app handles personal data. In summary, your data is stored on your device and is not transmitted to us.

7. Donations

You may choose to support development through a voluntary donation. Donations are gifts: they are not a payment for the app, do not purchase any goods, services, features or support, and do not create a contract for services between you and the developer. Donations are processed by an external payment provider under its own terms. Donations are generally non-refundable; if you made a donation by mistake, please contact us within 14 days and we will arrange a refund where the payment provider allows it.

8. Updates and availability

We may update, change or discontinue the app or any feature, for example to fix defects, improve security or comply with legal requirements. Where applicable law requires it, we will provide the updates necessary to keep the app in conformity, functioning and secure for a reasonable period.

9. Liability

The app is provided free of charge and “as is”. We take reasonable care in developing it, but we do not warrant that it will be uninterrupted or error-free, or that data synchronised with third-party services or devices will always be complete or accurate.

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of data that could have been avoided by keeping a backup. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional misconduct or gross negligence, or for any other liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer.

10. Ending these terms

You may stop using the app at any time by uninstalling it. We may suspend your licence if you materially breach these terms. Sections 2, 5, 9 and 12 continue to apply after these terms end.

11. Changes to these terms

We may amend these terms where reasonably necessary, for example to reflect changes to the app or to the law. We will publish the revised terms on this page and, for material changes, inform you within the app before they take effect. If you do not accept a change, you may stop using the app.

12. Governing law and disputes

These terms are governed by the laws of England and Wales. If you are a consumer resident in the European Union or elsewhere, you also benefit from the mandatory provisions of the law of your country of residence and may bring proceedings in the courts of that country. We encourage you to contact us first so that we can try to resolve any concern informally.
